Booking Terms and Conditions
These following terms and conditions reflect feedback from attendees at previous festivals and from event providers.
GENERAL
The Spirit of Speyside Whisky Festival sells tickets on behalf of event providers unless otherwise specified. This means that the final contract for your purchase will be between you and the event provider. By purchasing tickets and or attending an event you are deemed to have agreed to these terms and conditions and to be bound by them.
The officers of Spirit of Speyside Whisky Festival make every effort to ensure that all events are described accurately and fairly. In the unlikely event that a festival reservation is made on the basis of inaccurate information every effort will be made to resolve the mistake to the satisfaction of the customer. However individual entries on this website are entirely the responsibility of each event provider and the officers of Spirit of Speyside cannot be held responsible for any inaccuracies.
In the event of circumstances beyond our control, we reserve the right to alter programmes and events.
Payment
Payment can be made by Visa, MasterCard, Switch and Visa Debit Cards. Please note that the Festival does not accept American Express, Diners Club, Electron or Solo Cards.
Please note that each online booking is subject to a booking/processing fee.
Communication with Event Providers:
Event providers want to respond to your enquiries about events as quickly and appropriately as possible. Enquiries about all events should be made directly to the organiser of the event who is the best person to help you. The email address of the event provider is in the copy on the website or on the "electronic ticket" or booking confirmation. If you do not contact the event provider directly there may be a delay in your enquiry reaching them and it may not be possible for the event provider to respond appropriately.
CONFIRMED RESERVATIONS
'Electronic Ticket'
Once a booking is made and payment accepted you will receive an email confirmation or "Electronic Ticket". It is your responsibility to check that the confirmation issued to you is accurate. This email should be printed and presented at each event for admission.
Details of the event provider are on the electronic ticket. All communication about the event after the booking has been made should be with the event provider direct.
Reservations pending payment - This facility has been discontinued.
Refunds
Once a reservation has been made it can only be refunded with the agreement of the event provider. ALL reservations must be paid in full by credit card at the time of booking. This means there is instant visibility on the website of the number of tickets available for every event. The Festival's website booking system NO LONGER accepts payments by cheque or bank transfer.
Ticket Cancellations
The Festival is unable to offer refunds for cancelling a ticket to any event unless that ticket can be resold in full. Partial refunds cannot be considered in any circumstances. Ticket holders do not have a statutory right to cancel an online reservation. Any refunds are entirely at the discretion of the event provider. You must contact them direct if you wish to cancel an online reservation.
Under the Consumer Protection (Distance Selling) Regulations 2000 (as amended), purchasers of merchandise are entitled to a 'cooling-off' period of seven working days for merchandise purchased. This cooling-off period does not apply to tickets and leisure services as purchased through the Festival, as defined in the exceptions to those regulations. For the elimination of doubt, there is no cooling-off period for tickets purchased from the Festival, and bookings are non-refundable and non-exchangeable from the moment the purchaser clicks to confirm a purchase (unless the event providers changes dates/times or other details not in the favour of the purchaser).
Cookies
Cookies are used on the website where they are strictly necessary for the website to function. For example, the online ticket sales module and remembering what users have done when moving from page to page. Details are only remembered during the session and are not stored for future use.
CONDUCT AT THE FESTIVAL
Ticket holders are invited to consider fellow Festival-goers, presenters and event providers as well as residents of Speyside to ensure the maximum enjoyment of everyone during the Festival.
Admission: Please print your electronic ticket and show it at each event to gain admission. Please be prepared to identify yourself on arrival and to prove you are of legal drinking age where appropriate.
Event providers can reserve the right to refuse admission to ticket holders or require that they leave an event. Ticket holders must comply with such a request under the Licensing Act (Scotland). Failure to do so is a criminal offence. No refunds are given in these circumstances.
Smoking: The Smoking Health and Social Care (Scotland) Act 2005 and the Prohibition of Smoking in Certain Premises (Scotland) Regulations 2006 make it an offence for anyone to smoke within covered areas. In the interests of everyone's health and safety, these regulations will be rigidly enforced. Any ticket holder not adhering to this policy will be ejected from the event without refund.
Safety: Ensuring the health and safety of visitors is the responsibility of all event providers. Admission to events will be at the discretion of the event provider who reserves the right to refuse admission or to eject ticket holders in all reasonable circumstance without refund. In particular, any ticket holder acting in a manner likely to endanger themselves or others (for example where the ticket holder appears to be under the influence of drink and/or drugs, or is acting aggressively) shall be ejected from the event premises without refund.
Security: Event providers have the right to request that ticket holders and/or the personal property of ticket holders be submitted to a search. They will have the right to refuse admission or eject from the event any ticket holder who refuses such a request.
Lost Property: the festival accepts no responsibility for lost or stolen property
Late Admission: Ticket holders should ensure that they arrive in good time at events. Event providers want to ensure ALL ticket holders enjoy their events and may refuse admission to anyone who arrives more than 5 minutes after an event has started without giving a refund unless agreed beforehand with the event provider. When making bookings please allow for the late running of prior events or transport delays.
Mobile Phones: Please switch all mobile phones and similar devices to silent before events start. Ticket holders should not take or make calls during events. Anyone doing so may be asked to leave and may not be readmitted. No refunds will be given.
Food and Beverages: Only food and drink provided by the event provider or their authorised partners should be consumed on the premises where events are held without the express permission of the event provider.
Consumption of Alcohol: Please note that by law the consumption of alcohol is limited to those over the age of 18. The purchase of tickets for whisky tasting events and admission to these events is limited to those over the age of 18. We reserve the right to request proof of age from any ticket holder who appears to be under the age of 25. Such proof must include a photograph and state the date of birth of the ticket holder. There are many events at the Festival that are suitable for persons under the legal drinking age.
Any ticket holder who appears to be drunk will be refused admission or required to leave. No refunds will be given. The Festival encourages responsible drinking.
Please drink in moderation and do not drink and drive.
Noise: Ticket holders are asked not to interrupt any presenter who is talking. This restriction may apply to making oral translations if these are intruding on the enjoyment of other ticket holders. The event provider can ask ticket holders who insist on making a noise to leave. No refunds will be given.
Photography and Recording: Photography is permitted at events unless stated otherwise by the event provider but should not intrude on the enjoyment of others. The use of recording devices of any form is not permitted unless express permission has been given by the event provider and the presenter in advance.
Photography Consent
You consent to filming, photography and sound recording as visitors of the booked event and to the use, reproduction, storage and broadcasting of such film and recording (including copies made) by the event provider, us or our representatives.
Pets: No pets or animals are permitted at events or on the premises where events are held unless the express permission is given in advance by the event provider.
Finishing Times: The published finishing times are approximate only. All event providers will endeavour to keep to the published schedule but due to the interactive nature of many events this can be difficult. Ticket holders should make provision accordingly.
At the end of Events: Speyside is a peaceful and friendly area. Please leave events as quickly and as quietly as possible.
DISCLAIMER
Event providers are responsible for their own events.
The Spirit of Speyside Whisky Festival is not responsible for the events, services, actions or failure to act of any event provider, venue, performer or other third party in connection with its website or services.
By booking a Festival event and accepting these terms and conditions, you agree to indemnify us against any loss, injury, fines, costs and expenses incurred by us as a result of your use of our site or service.
